Using Standards to Drive Quality Public Defense: Overcoming Fear, Moving Forward for Clients

This session will attest to the power of standards to improve the quality of public defense representation. It will address the fears that new standards may instill in individuals and institutions affected by them. The session will draw on the rich history of NLADA standards, examples of current improvements in quality inspired by recent New York State Office of Indigent Legal Services' (ILS) standards, and the New York State Defender Association's tandem use of client-developed and attorney-drafted standards to advocate for a client-centered approach to public defense. Standards for criminal defense and for representation of adults in family court will be discussed. Presenters and participants will talk about creating standards, and two on-the-ground lawyers from legal aid societies will talk about how they changed their practices to conform with the new ILS standards in New York State.
