Where's My Attorney? Providing Counsel at Three Stages

While public defense reformers struggle with constructive denial of counsel, actual denial of counsel remains a great problem in the United States. From arrest, to bail hearings, to guilty pleas, many Americans are cycled through the justice system without a lawyer. The failure to provide counsel raises myriad legal and ethical questions: What are the critical stages at which counsel is required? How do we ensure that counsel is provided? Should counsel be provided even if the stage is not critical? This session will explore the right to counsel at three stages: (1) the police station; (2) first appearance; and (3) guilty pleas. The session will emphasize that the first-appearance and guilty-plea stages are often combined in a single court appearance, further complicating this issue. Participants should leave with an understanding of (1) when the right to counsel is triggered; (2) the critical difference counsel can make; (3) how the right to counsel is often denied; (4) the inadequacies of current waiver forms and colloquies; and (5) the ways in which public defense reformers are attempting to expand the right to counsel.
